This New Ordinance Will Let You Drink in Public. Don't worry about chugging the rest of your beer—Denver's new "common consumption" ordinance will allow you to bring your drink outside of some liquor-licensed businesses.
Can I Drink or Have An Open Container in Public? In the state of Colorado, drinking alcohol with restrictions is permitted in public areas such as state or city parks. Colorado state law allows individuals to consume alcoholic beverages in public places that contain 3.2% or less ABV.
But there are also laws about alcohol consumption, especially if you're interested in public consumption. Drinking in public places--including sidewalks, parks, stadiums, and beaches--is considered illegal in most jurisdictions in the U.S. Penalties range from hundreds of dollars in fines to jail time.
According to these statutes, a person under the age of 21 may consume alcohol… On private property (that is, where a person habitually resides and NOT a place of business) with the consent of a parent or guardian in the parent's presence.
Beer drinking is only allowed while fishing when it's hands free.
The possession and consumption of Alcohol Beverages is prohibited in parks and other outdoor public spaces managed by DPR except for fermented malt beverage or malt liquor (beer) and vinous liquor (wine or champagne). The sale and/or service of Alcohol Beverages is prohibited in parks and other outdoor public places.
Alcohol is allowed in city and state parks, but only to an extent. You can drink in city and state-run parks throughout Colorado, but only when the percentage of alcohol is 3.2 percent or less. Essentially, this is the limit of light beer or wine spritzers. Glass bottles are not allowed, regardless of alcohol content.
Alcoholic beverages are permitted on park property, with the exception of archery or shooting ranges unless specifically authorized and permitted. Possession of alcoholic beverages by anyone under 21 years of age is prohibited.
