Generally, citizens can (successfully) sue the police for infliction of emotional distress in one of two instances, when an officer: intentionally or recklessly acts in a way that causes emotional injury or. causes emotional distress through a negligent act.
The police misconduct complaint will be investigated by a trained investigator. The investigation may include interviews of witnesses and officers, a review of police department records, policies and procedures, inspection of medical records and photographs, and legal analysis.
This is possible because federal law, specifically 42 U.S. § 1983, allows a person to sue a police officer or other government official who violates the person's civil rights.
To lodge a formal complaint with the Law Enforcement Conduct Commission (LECC) go tonsw.gov.au. The Law Enforcement Conduct Commission is an independent statutory body responsible for investigating complaints against the police.
Police misconduct occurs when, while performing their official duties, an officer's conduct violates an individual's constitutional rights or the officer commits an illegal act (i.e., drug abuse, sexual assault, etc.).
The basic premise of the Garrity protection is straightforward: First, an Officer cannot be compelled, by the threat of serious discipline, to make statements that may be used in a subsequent criminal proceeding; second, an Officer cannot be terminated for refusing to waive his Fifth Amendment right to remain silent.
If you sue the police for misconduct and win, you may be awarded damages, or monetary compensation, as restitution for the violation of your civil rights and any physical or emotional injuries.
Write an application to the Superintendent of Police concerned, by post under clause 3, Section 154 and Section 36 of the Criminal Procedure Code who in case of a cognizable offence, can either investigate the case himself or direct any police officer subordinate to him to investigate the case.
