The answer is NO they can't get the money back from you, if you don't want to pay them back. The only option they have is to charge your Paypal account, and it will start showing negative balance. If you want to continue using this Paypal account then you will have to payback the negative amount.
You can refund the entire amount of a transaction or portions of it. The default refund period is 180 days from the transaction date. If you refund a payment for goods or services, there are no fees to process the refund, but the fees you originally paid as the seller are not returned to you.
Steps
- Gather all documentation related to the scam.
- Call the customer service number for your bank or credit card company.
- Provide information about the scam to your bank or credit card company.
- Answer follow-up questions from your bank or credit card company.
- Follow up if you don't hear back within 30 days.
Once a scammer has hacked into somebody else's PayPal account (as in the case of the phishing email scam), they can make purchases and send payments with the money from the account they have taken over. PayPal may reimburse the seller if they are able to confirm that the account that made the payment was hacked.
To do so:
- Log in to your PayPal account.
- Go to the Resolution Center.
- Click View next to the dispute you want to escalate.
- Click Escalate this dispute to a PayPal claim near the bottom of the page.
- Follow the instructions.
- Click Escalate to a claim.
PayPal will notify you by email when a buyer opens a dispute. PayPal will place a temporary hold on all funds involved in this transaction until the dispute has been resolved or closed. Once a decision is final, these funds will either be released to you or refunded to the buyer.
How to issue a refund on PayPal
- Log into your PayPal account.
- Click Transactions near the top of the page.
- Click the payment you want to refund.
- Click Issue a refund.
- For "Refund amount," enter the amount you want to refund, and then click Continue.
Just so you all know; friends and family payments can be reversed. PayPal will not do it, however, if you dispute a friends and family charge with your bank, they are capable of reversing it. For example, if you claim that your account was hacked, they can and have reversed payment.
Unless you call paypal and somehow get a sympathetic rep who will open a dispute.. there is no other way to get your money back. Your only recourse is to file a dispute on the transaction through your credit card issuer. There is no purchase protection on friends & family payments, they're same as cash.
This is not a scam, your choice to violate PayPal policy and terms of service to use friends/family for purchased goods. You can't just cancel money sent as friends/family such payment is not suspicious as you willinging made the payment.

If you are at a restaurant, ask to speak with the manager. If the service is provided away from a physical location, call the company and ask to speak with the person in charge. Once you have the attention of someone in charge, coolly and calmly explain why you feel you deserve a refund.
